Terms and Conditions of Service
The following terms and conditions are governed by English law, and are subject to the jurisdiction of the English courts. By authorising GS Systems & Components to carry out repair work, either verbally, in writing or by electronic means, you agree to be bound by these terms.
1. Authorisation
The client authorises GS Systems & Components to conduct an evaluation of the machine sent, collected or delivered to determine the nature of the damage and provide an estimate of repair cost and timing. The evaluation is free and no work beyond this evaluation will be charged without explicit client approval. By accepting any quote or offer of service from GS Systems & Components the client agrees to pay any sums due in respect of any work carried out and any components acquired on behalf of the client. The client authorises GS Systems & Components, its employees, and agents, to receive and transport this media/equipment/data to, from and between their facilities.
2. Legal Rights
The client is the legal owner or authorised representative of the legal owner of the property and all data and components contained therein sent to GS Systems & Components. Any property left with GS Systems & Components unclaimed for 90 days, will be disposed. At which time, GS Systems & Components shall have no liability to the client or any third party.
3. Limited Liability
GS Systems & Components shall not be liable for any claims regarding the physical functioning of equipment/media or the condition or existence of data on storage media supplied before, during or after service. In no event will GS Systems & Components be liable for any damage to the laptop/desktop, loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages, however caused, before, during or after service even if GS Systems & Components has been advised of the possibility of damages or loss to persons or property. GS Systems & Components liability of any kind with respect to the services, including any negligence on its part, shall be limited to the contract price for the services. The client and GS Systems & Components agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at GS Systems & Components option, additional attempts by GS Systems & Components to recover satisfactory data or repair to the client’s satisfaction. The parties acknowledge that the price of GS Systems & Components services would be much greater if GS Systems & Components undertook more extensive liability. The client is aware of the inherent risks of injury and property damage involved in laptop/desktop repair, including without limitation, risks due to destruction or damage to the machine, media, or data and inability to repair the machine or recover data, including those that may result from the negligence of GS Systems & Components, and assumes any and all known risks of injury and property damage that may results.
4. Confidentiality
GS Systems & Components agrees not to disclose any and all information or data files supplied with, stored on, or recovered from client's equipment except to employees or agents of GS Systems & Components subject to confidentiality agreements or as required by law.
5. Payment
Payment is due in full upon completion of successful repair, prior to release of the repaired machine (whether Delivered, or picked up), unless by special previous arrangement. We accept Cash, PayPal and Bank Transfers.
6. Warranty
60 days warranty on laptops/desktops that GS Systems & Components has repaired, GS Systems & Components makes no warranty on data, express or implied, and GS Systems & Components disclaims any data warranty of any kind.
7. Title of Property
The title to the Goods shall remain with GS Systems & Components until the client pays all sums owing to GS Systems & Components whether in respect of this contract or otherwise. We reserve the right to sell such goods if invoices or services remain unpaid after ninety (90) days. Outstanding invoices and any other costs incurred to recover said services or invoices will be due in full. We reserve the right to pass title of any debt to a debt collection agent, which will affect the clients’ credit score. The risk in Goods supplied by GS Systems & Components shall pass to the client on delivery of the Goods to or to the order of the Client in accordance with the terms of the Contract. We shall be entitled to recover the price of the Goods including VAT even though the property in any of the goods remains with GS Systems & Components. We shall be entitled at any time to recover any or all of the Goods in the clients possession to which GS Systems & Components have title and for that purpose the client will on request deliver up Equipment containing such Goods. GS Systems & Components, Our servants or agents may with such transport as is necessary entering upon any premises occupied by the client or to which the client has access and where the Goods may be or are believed to be situated. When payment for Goods is overdue or the Client suffers distress or execution to be levied against his or its effects, makes an arrangement or composition with creditors or, being a corporate body, enters into liquidation (otherwise than for the purpose of amalgamating or reconstruction where the corporate body, as amalgamated, accepts in full the Client's liability of pay for the Goods), or has a receiver appointed for the whole or any part of its undertaking or, being an individual, has a receiving order in bankruptcy made against him, then: a) If the Client remains in possession of the Goods, whether or not the Client has sold them GS Systems & Components shall be entitled to recover the Goods from the Client or b) If the Client has parted with possession of the Goods by way of sale, whether or not the Goods have been mixed with or incorporated into other Goods, the Client having sold them as fiduciary bailee, shall hold in trust for GS Systems & Components so much of the proceeds of sale of the Goods as represents the Client's liability to GS Systems & Components in respect of them.
8. No fix no fee policy
Our no fix, no fee policy means that if GS Systems & Components does not possess the necessary technical knowledge or ability to resolve the problem or effect the repair, then no charge is made to the client excepting the cost any components fitted. If GS Systems & Components is able to resolve the problem or effect the repair, but is only prevented from doing so by the client requesting the engineer not to proceed with the work, then the client is charged for the engineer's time spent to that point - i.e. minimum of 1 hour. If GS Systems & Components is able to resolve the problem or effect the repair, but is only prevented from doing so because the client does not possess the required, software CD-Rom or Product Key, then the client is charged for the engineer's time spent to that point -. i.e: a minimum of 1 hour. If GS Systems & Components provides a clear and precise diagnosis of a failed component or nature of repairs required and the client decides not to proceed after repairs are commenced at clients instruction and such components are fitted, then the client is charged for the engineer's time and components fitted to that point. The policy does not apply to work related to data recovery, computer virus or spyware problems.
